These Terms & Conditions govern the use of www.kaaita.com and purchases made through the Kaaita online shop.

By placing an order, you confirm that you have read and accepted these Terms & Conditions.

2. Scope of these terms

These Terms & Conditions apply to purchases made through the Kaaita online shop.

Separate written terms may apply to customised, wholesale, bulk or hospitality orders placed directly with Kaaita. Where separate terms are agreed in writing, those terms take precedence for the relevant order.

Nothing in these Terms & Conditions limits any mandatory rights granted to consumers under applicable law.

3. Products

We take reasonable care to describe and display our products accurately.

Many Kaaita products are made from natural, recycled or repurposed materials. Small variations in colour, texture, thickness, stitching, dimensions or appearance may therefore occur. These variations are part of the character of the materials and are not necessarily defects.

Colours may appear slightly different depending on the customer’s screen and device settings.

Product dimensions and measurements are approximate unless expressly stated otherwise. Customers should consult the available product descriptions and sizing information before placing an order.

4. Product availability

All orders are subject to availability.

Adding a product to the shopping cart does not reserve it. If a product becomes unavailable after an order has been placed, we will contact the customer and refund the amount paid for the unavailable product.

We reserve the right to limit the quantity of products available to an individual customer where reasonably necessary.

5. Prices and taxes

Prices are displayed in euros unless otherwise stated.

Prices include VAT where applicable. Shipping costs and any other applicable charges are displayed separately before the customer completes the purchase.

For deliveries outside the European Union, the customer may be required to pay local import duties, customs charges or taxes. Unless expressly stated otherwise during checkout, these charges are not included in the purchase price and are the customer’s responsibility.

6. Placing an order

Before submitting an order, the customer can review and correct the selected products, quantities, delivery information and other entered details.

By clicking the final purchase button, the customer submits a binding order and agrees to pay the displayed total price.

After the order has been placed, the customer will receive an electronic order confirmation. The sales contract is concluded when Kaaita sends the order confirmation, unless we subsequently inform the customer that the order cannot be accepted for one of the reasons described below.

We may refuse or cancel an order in cases including:

  • the product being unavailable;

  • an obvious error in the price or product description;

  • payment not being authorised;

  • suspected fraud or misuse;

  • delivery being unavailable to the selected destination; or

  • a material breach of these Terms & Conditions.

If payment has already been received for an order we cannot fulfil, the payment will be refunded.

7. Payment

The available payment methods are displayed during checkout and may include payment cards, PayPal or other payment services.

Payments are processed securely by the selected payment provider. Kaaita does not receive or store complete payment-card details.

The customer is responsible for ensuring that the payment and billing information supplied is accurate and that they are authorised to use the selected payment method.

8. Delivery

We deliver to the destinations available during checkout.

Available delivery methods, delivery costs and estimated delivery times are displayed during checkout or provided in the order confirmation.

Delivery times are estimates and may be affected by the destination, customs procedures, public holidays, weather, carrier delays or other circumstances beyond our reasonable control.

The customer is responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.

For consumer purchases, the risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, physically receives the products.

9. Cancelling an order

If you wish to cancel an order before it has been dispatched, please contact us as soon as possible at sayhay@kaaita.com.

We will try to stop the shipment, but we cannot guarantee cancellation once the order has entered processing or has already been dispatched.

Consumers generally have the right to withdraw from an online purchase within 14 days after receiving the goods, subject to the exceptions provided by law.

Please contact us at sayhay@kaaita.com before sending a return so that we can provide the correct return instructions.

Where the customer exercises the statutory right of withdrawal, the customer is responsible for the direct cost of returning the products unless the products are faulty, damaged, incorrect or not as described.

11. Personalised and made-to-order products

Products made to the customer’s specifications or clearly personalised cannot normally be cancelled or returned under the statutory right of withdrawal.

This restriction applies only where the product was clearly identified as personalised or made to order before the purchase was completed.

The restriction does not apply if the product is faulty, damaged, incorrect or does not conform to the agreement.

Any additional conditions applying to a personalised or made-to-order product will be communicated before the order is completed.

12. Product conformity and legal guarantee

Kaaita is responsible for delivering products that conform to the sales contract.

If a product is faulty, damaged, incorrect or not as described, please contact sayhay@kaaita.com with the order number, a description of the issue and photographs where relevant.

Consumers in the European Union benefit from a minimum two-year legal guarantee for products that are faulty or do not conform to the contract.

Depending on the circumstances and applicable law, the customer may be entitled to repair, replacement, a price reduction or termination of the contract and a refund.

Nothing in these Terms & Conditions excludes or limits mandatory consumer rights.

13. Promotions and discount codes

Promotions and discount codes are subject to any specific conditions stated with the offer.

Unless otherwise stated:

  • only one discount code may be used per order;

  • discount codes cannot be exchanged for cash;

  • discount codes cannot be applied retrospectively;

  • discounts do not apply to shipping costs; and

  • promotions are valid only during the stated period and while stocks last.

We may cancel or refuse a promotion where there is evidence of fraud, misuse or an obvious technical error.

14. Intellectual property

All content on www.kaaita.com, including text, photographs, illustrations, product designs, logos, graphics and other materials, is owned by or licensed to Kaaita and is protected by applicable intellectual-property laws.

The content may not be copied, reproduced, modified, distributed or used for commercial purposes without our prior written permission.

15. Website use

The website must not be used:

  • for unlawful or fraudulent purposes;

  • to interfere with its security or operation;

  • to transmit malicious or harmful code;

  • to collect information about other users without authorisation; or

  • in a way that infringes the rights of Kaaita or another person.

We may restrict access to the website where it is used improperly.

16. Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or liability arising from mandatory consumer rights.

To the extent permitted by law, Kaaita is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was concluded.

For customers purchasing primarily for business or professional purposes, Kaaita is not liable for loss of profit, revenue, business, anticipated savings, data or business opportunity, except where such a limitation is prohibited by law.

17. Events beyond our control

Kaaita is not responsible for delays or failure to perform its obligations where this is caused by circumstances beyond our reasonable control.

Such circumstances may include natural disasters, strikes, interruptions to transportation or communications, government measures, epidemics, customs delays or failures of third-party services.

We will take reasonable steps to reduce the effect of such circumstances and fulfil our obligations as soon as reasonably possible.

18. Personal data and cookies

Personal data is processed in accordance with our Privacy & Cookie Policy.

Where consent is required for optional cookies or electronic marketing, customers may give, refuse or withdraw that consent as described in the Privacy & Cookie Policy.

Please include your name, order number and a clear description of the issue. We will review the complaint and respond as soon as reasonably possible.

Kaaita d.o.o. does not currently recognise any registered provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer may initiate, unless participation is required by applicable law.

20. Governing law and jurisdiction

These Terms & Conditions and the sales contract are governed by the laws of the Republic of Slovenia.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection granted by the law of your country of residence.

Any disputes will be submitted to the competent courts in accordance with applicable law. Consumers may have the right to bring proceedings before the courts of their country of residence.

21. Changes to these terms

We may update these Terms & Conditions where necessary, for example because of changes to our services, business practices or legal requirements.

The version applicable to an order is the version available on the website when the order is placed.
